Terms of Service

Welcome to CookLore. By accessing or using our mobile application and services, you agree to comply with and be bound by these Terms of Service. Please read them carefully.

1. Contractual Relationship

These Terms of Service ("Terms") constitute a legally binding agreement between you and Webonmaster, Bern, Switzerland ("we", "us", or "our"), governing your use of the CookLore mobile application (the "App") and associated services.

By creating an account or accessing the App, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you must immediately cease using the App.

2. Account Registration & Security

In order to utilize key features of CookLore, including adding, cataloging, and sharing food recipes, **you must register and create an active user account.**

• Eligibility: You must be at least 13 years old (or 16 years old if residing in certain EU jurisdictions with higher age thresholds for data processing consent) to register.
• Accuracy: You agree to provide accurate and complete registration details. You are solely responsible for updating your profile if information changes.
• Security: You are responsible for safeguarding your login credentials (passwords, social tokens). Any activity under your account is deemed your responsibility. If you suspect unauthorized access, contact us immediately at info@webonmaster.com.

3. User-Generated Content & Recipe Ownership

CookLore enables users to upload recipe texts, lists of ingredients, culinary instructions, reviews, ratings, comments, and photographs (collectively, "User Content").

• Retention of Ownership: You retain full copyright and ownership of the original recipes and images you submit to CookLore.
• License to Public Content: By marking a recipe as "Public", you grant CookLore a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sublicensable license to host, store, copy, modify, distribute, display, perform, and syndicate that specific recipe in connection with operating and promoting the CookLore platform and community.
• No License to Private Content: Recipes designated by you as "Private" remain confidential. We do not obtain a license to display, publish, or share your private recipes. They are hosted strictly on secure server partitions for your personal access.
• Representations: You represent that you own or have the necessary intellectual property rights and permissions for all User Content you upload, and that it does not violate copyright laws or trademark protections.

4. Social Interactions & Following

The App facilitates social connections through following. When you follow a user, you agree to receive notifications regarding their public recipe postings. You agree to interact with other community members respectfully. We reserve the right to suspend or ban users who engage in harassment, spam, hate speech, or abuse of the social system.

5. Acceptable Use & Conduct

You agree not to use the App to upload, post, or distribute any User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy.
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights.
• Contains instructions or ingredients that promote dangerous, hazardous, or harmful culinary preparation methods (such as recipes involving poisonous substances or dangerous food safety violations).
• Contains software viruses or any code designed to disrupt or limit the functionality of the App.

6. Disclaimers & Health Warning

CookLore is a platform for sharing recipes and kitchen diaries. We do not audit or test user-submitted recipes for safety, accuracy, allergen warnings, or nutritional value.

Culinary Disclaimer: All recipes and instructions are followed at your own risk. Webonmaster is not responsible for food poisoning, allergic reactions, kitchen injuries, or culinary failures resulting from preparing recipes hosted in the App. Users are advised to exercise common sense and comply with local health and food safety standards.

7. Limitation of Liability

To the maximum extent permitted by applicable Swiss and European consumer protection laws:

• Webonmaster shall not be liable for any indirect, incidental, special, exemplary, or consequential damages arising out of your use or inability to use the App.
• Our liability for ordinary negligence is completely excluded. Under Swiss law, liability for intent (intentio) or gross negligence (culpa lata) cannot be excluded and remains unaffected.
• We are not responsible for User Content or the conduct of any other CookLore user.

8. Account Deletion & Termination

By You: You can delete your account at any time via the settings screen inside the App. Account deletion removes your access, all follow records, and completely deletes all your private and public recipes from our active databases within 30 days.

By Us: We reserve the right to suspend or terminate your account or restrict your access to all or part of the App if we determine, in our sole discretion, that you have violated these Terms, violated applicable law, or engaged in behavior harmful to our community.

9. Governing Law & Jurisdiction

These Terms and your use of CookLore shall be governed by, and construed in accordance with, Swiss Law, excluding its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Bern, Switzerland.

For EU consumers, mandatory consumer protection laws and statutory rules of jurisdiction of the country of their residence remain unaffected by this choice of law and forum.

10. Changes to Terms

We may modify these Terms from time to time. We will notify you of any material updates (e.g. via app notification or email). Your continued use of the App after updates become effective constitutes acceptance of the modified Terms.
